Public Advocate Letitia James Declares Win In Suit Against City Over Air Conditioned School Buses For Special Needs Students

The dog days of summer may be coming to an end, but Public Advocate Letitia James is still fighting the city for failing to cool more than 400 school buses that transport kids with special needs.

On Tuesday, James claimed a legal victory when the State Supreme Court ruled that a lawsuit James brought against the city last year can move forward.

Of the 3,000 special ed bus routes operated by the city, about 2,570 — or roughly 86% — have air conditioning, according to the city Education Department. James is suing to force the city to provide cooling on all routes.

James said the decision protects her ability to advocate for the public. “We will continue to use all tools at our disposal, including litigation, to protect the rights of all New Yorkers,” she said.

James had scored another legal win on June 18 with a court order forcing the city to operate air-conditioning on two routes that had spotty or nonexistent cooling.

City Law Department spokesman Nick Paolucci said the city would appeal the State Supreme Court’s Tuesday ruling.

“The Department of Education is committed to ensuring air-conditioned buses for all students who require them,” Paolucci said. “Any concerns are immediately addressed.”
